Welcome to Mimosa.pop! These terms apply to all purchases and use of this website. Please read them before placing an order.

1. Who we are

This store is operated by Tiina Makkonen Art (business ID 3417591-7), under the brand name Mimosa.pop. In these terms, "I", "me" and "my" refer to Tiina Makkonen Art, and "you" refers to the customer or visitor.

2. Who can order

These terms are written for consumers and business customers ordering for delivery in Finland. To place an order, you must be at least 18 years old or have permission from your parent or guardian.

3. Products

- Original artworks are one of a kind. Each original is hand-painted and framed in a recycled frame, so small marks and signs of age in the frame are part of its character and are not considered defects.
- Art prints, cards and other products are made from my original artworks.
- I do my best to show colours and details accurately, but they may look slightly different on your screen.
- Sizes are approximate and may vary slightly.
- Products are available while stock lasts. If an item sells out before your order is confirmed, I will let you know and refund any payment in full.

4. Prices and payment

- All prices are in euros and include VAT.
- Shipping costs are not included in the product price. They are shown at checkout before you pay.
- Available payment methods are shown at checkout. Your payment is handled securely by our payment service providers.
- If a product has an obvious pricing error, I am not bound by that price. I will contact you and you can choose to continue at the correct price or cancel the order for a full refund.

5. Placing an order

When you complete checkout, you make an offer to buy the products in your order. The contract is formed when you receive an order confirmation by email. Please check that the details in your confirmation are correct and contact me as soon as possible if something is wrong.

6. Shipping and pickup

Delivery options, processing times and shipping details are described in our Shipping Policy. The risk of damage or loss passes to you when the order has been delivered to you.

7. Right of withdrawal and returns

If you are a consumer, you have a 14-day right of withdrawal. Our Refund & Return Policy explains how to cancel an order, how to return items and when the right of withdrawal does not apply.

8. Defects and complaints

If a product is faulty or does not match your order, please contact me as soon as possible and within a reasonable time after you noticed the issue. Your rights under the Finnish Consumer Protection Act always apply. More information is available in our Refund & Return Policy.

9. Gift cards

- Gift cards are digital and delivered by email unless agreed otherwise.
- A gift card can be used in this online store and is valid for one year from the date of purchase.
- A gift card cannot be exchanged for cash, except where required by law.
- Keep your gift card code safe. It works like cash, and I cannot replace a card that has been lost or used by someone else, unless the code can be identified and the balance is still unused.

10. Commissions

Commissioned artworks are agreed individually, including the design, price, payment schedule, delivery time and shipping. Because a commissioned artwork is made to your personal wishes and specifications, the right of withdrawal does not apply to it. Your rights regarding defects still apply.

11. Copyright and use of artwork

All artworks, images, texts and other content on this website are protected by copyright and belong to Tiina Makkonen Art unless stated otherwise.

Buying a product gives you ownership of that physical item. It does not give you the right to copy, reproduce, print, sell or use the artwork or images commercially. You are welcome to share photos of your Mimosa on social media for personal use, and I always love to be tagged @mimosa.pop!

12. Using this website

Please do not misuse this website, for example by trying to disrupt it or access it without permission. I may update the website, change the product range or temporarily take the website offline, for example for maintenance.

13. Liability

I am not responsible for delays or failures caused by events beyond my reasonable control, such as carrier disruptions, strikes, power or network outages, or natural events. Nothing in these terms limits your statutory rights as a consumer or any liability that cannot be limited by law.

14. Privacy

Our Privacy Policy explains how personal data is collected and used.

15. Governing law and disputes

These terms are governed by the laws of Finland. If we have a disagreement, please contact me first and we will try to solve it together.

If you are a consumer and we cannot reach an agreement, you can contact the Finnish consumer advisory service (Kuluttajaneuvonta) and take the dispute to the Consumer Disputes Board (Kuluttajariitalautakunta, www.kuluttajariita.fi). You also have the right to bring a claim to a Finnish district court, including the court of the area where you live.

16. Changes to these terms

I may update these terms from time to time. The version published on this website at the time of your order applies to that order.
